1. Services Offered

Shooting Trio Photography provides professional sports photography services, including but not limited to:

• Team and group photography for youth sports, schools, and leagues
• Individual sports portraits and senior banners
• Action photography during games and events
• Custom photography packages and print products

Specific services, deliverables, and pricing will be outlined in your booking agreement or quote.

2. Booking and Scheduling

Session Booking

• Sessions must be booked through our online booking system or by contacting us directly
• Booking confirmation will be sent via email and is subject to availability
• A signed agreement and deposit may be required to secure your booking
• Session details (date, time, location) will be confirmed at least 48 hours before the scheduled date

Rescheduling and Cancellations

• Client Cancellations: Must provide at least 48 hours notice. Cancellations within 48 hours may forfeit deposit
• Weather-Related Changes: Outdoor sessions may be rescheduled due to inclement weather at no additional charge
• Photographer Cancellations: In rare cases where we must cancel, we will provide full refund or reschedule at your convenience
• No-Shows: Failure to appear for a scheduled session without notice will result in forfeiture of all deposits and fees

3. Payment Terms

Pricing and Fees

• All prices are in US Dollars and subject to change without notice
• Current pricing will be provided in your quote or booking agreement
• Prices may vary based on session type, location, duration, and deliverables
• Additional fees may apply for rush orders, travel outside our service area, or special requests

Payment Methods

• We accept credit cards, debit cards, and other payment methods as specified
• Payment processing is handled through secure third-party payment processors
• Deposits (if required) are typically 25-50% of total package price and due at booking
• Final payment is due before or at the time of photo delivery, unless otherwise agreed

Refunds

• Deposits are generally non-refundable unless we cancel the session
• Digital products and downloads are non-refundable once delivered
• Print products may be refunded or replaced if defective or damaged during shipping
• Refund requests must be submitted within 14 days of delivery

4. Photography Sessions

Client Responsibilities

• Arrive on time for scheduled sessions
• Provide accurate information (names, team rosters, contact details)
• Ensure minors have parental/guardian consent and supervision
• Follow photographer's directions for safety and optimal results
• Obtain necessary permissions for shooting at private venues

Photographer Responsibilities

• Arrive on time and prepared with professional equipment
• Conduct sessions in a professional and respectful manner
• Deliver photographs according to agreed timeline and specifications
• Make reasonable efforts to capture quality images

Session Duration

• Session length will be specified in your booking agreement
• Extended sessions beyond agreed time may incur additional fees
• Game/event coverage duration depends on event schedule and package purchased

5. Photo Delivery and Usage Rights

Delivery Timeline

• Standard delivery: Digital photos within 7-14 business days
• Rush delivery: Available for additional fee (2-5 business days)
• Print products: 2-4 weeks depending on product type
• Team/league photos: May require additional time for processing large orders

Digital File Access

• Digital files provided via secure online gallery or download link
• Access links expire after 90 days unless otherwise specified
• Clients are responsible for downloading and backing up their files
• Re-delivery of files after expiration may incur a service fee

Copyright and Ownership

• Photographer Retains Copyright: All photographs are copyrighted works owned by Shooting Trio Photography
• Personal Use License: Clients receive a non-exclusive license to use purchased photos for personal, non-commercial purposes
• Allowed Uses: Social media sharing, personal prints, family displays, school yearbooks (with credit)
• Prohibited Uses: Commercial use, resale, reproduction for profit, removal of watermarks without permission
• Commercial Licensing: Available upon request for additional fee

Photographer's Portfolio Rights

• We reserve the right to use photographs for marketing, portfolio, social media, and promotional purposes
• Images may be used on our website, social media, advertisements, and print materials
• Clients may opt-out of marketing use by providing written notice (see Privacy Policy)
• We will make reasonable efforts to honor removal requests after publication

6. Proof Selection and Editing

Photo Selection

• Photographer has sole discretion over which images are edited and delivered
• We deliver only our best work that meets professional quality standards
• Number of delivered photos varies by package and session type
• Unedited/raw files are not provided unless specifically contracted

Editing and Retouching

• All delivered photos include standard color correction and enhancement
• Advanced retouching (blemish removal, background changes) may incur additional fees
• Editing style and creative decisions are at photographer's discretion
• Minor adjustment requests may be accommodated at no charge

7. Liability and Limitations

Limitation of Liability

• Our total liability shall not exceed the amount paid for services
• We are not liable for missed shots due to circumstances beyond our control (equipment failure, event restrictions, poor lighting conditions)
• We are not responsible for backgrounds, bystanders, or elements outside our control appearing in photographs
• Backup equipment is utilized, but complete equipment failure remains a possibility

Force Majeure

We are not liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to: natural disasters, extreme weather, illness, pandemic restrictions, venue closures, or other unforeseen events.

Photo Backup and Storage

• We maintain backup copies of photos for a minimum of 90 days after delivery
• After this period, we are not responsible for recovering or re-delivering lost files
• Extended archival storage may be available for additional fee
• Clients are responsible for backing up their downloaded files

8. Model Release and Consent

Adult Subjects

By participating in a photography session, adult subjects grant permission for their likeness to be photographed and used in accordance with these Terms and our Privacy Policy.

Minor Subjects

• Parent or legal guardian must provide consent for minors to be photographed
• Team/league photography: Consent is typically obtained through team registration or participation agreement
• Individual sessions: Signed model release may be required
• Parents/guardians may opt-out of marketing use of minor's photos

9. Conduct and Behavior

We maintain a professional, family-friendly work environment. We reserve the right to:

• Refuse service to anyone behaving inappropriately, disrespectfully, or dangerously
• Terminate sessions early due to safety concerns or inappropriate conduct
• Ban clients from future services for violations of these Terms
• No refunds will be issued for sessions terminated due to client misconduct

10. Third-Party Services

• We may use third-party vendors for printing, online galleries, and payment processing
• These services are subject to their own terms and privacy policies
• We are not responsible for third-party service failures or policies
• Quality of print products depends on third-party lab standards

11. Website Use

Acceptable Use

• You may browse our website for personal, non-commercial purposes
• Do not attempt to hack, disrupt, or exploit our website
• Do not copy, reproduce, or scrape website content without permission
• Respect intellectual property rights of all website content

User-Generated Content

• Comments, reviews, or messages submitted to us may be used for marketing purposes
• We reserve the right to remove inappropriate or offensive content
• You grant us a license to use your submitted content

12. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, photographs, and design elements, is protected by copyright and trademark laws. Unauthorized use is prohibited.

• Website content may not be reproduced without written permission
• Trademarks and logos are property of their respective owners

13. Dispute Resolution

Complaints and Issues

• We will make good-faith efforts to address legitimate complaints
• Disputes should be reported within 14 days of the issue occurring

Governing Law

These Terms are governed by the laws of the State of Idaho, United States. Any disputes shall be resolved in the appropriate courts of Ada County, Idaho.

Mediation and Arbitration

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation and, if necessary, mediation before pursuing legal action.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.

For existing bookings, the Terms in effect at the time of booking will apply unless changes are required by law.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, along with your booking agreement and our Privacy Policy, constitute the entire agreement between you and Shooting Trio Photography regarding our services.
